1.- PRELIMINARY PROVISIONS

The service provider is ENLAGLORIA SALADS, S.L. (hereinafter referred to as ENLAGLORIA SALADS, S.L.), located at C/ AVENIR, 66, 08021, BARCELONA, with a telephone number of 613066511 and an email address HOLA@ENLAGLORIASALADHOUSE.COM, and CIF B67291393.

This document regulates the terms and conditions governing the acquisition of products offered by ENLAGLORIA SALADS, S.L. through this website.

In addition to reading these Conditions, before accessing, browsing, and/or using this website, the user should read the Legal Notice, Privacy Policy, and Cookie Policy. By using this website, by making and/or requesting the acquisition of products through it, the user consents to be bound by these conditions and by all of the aforementioned, so if they do not agree with any of it, they should not use this website.

ENLAGLORIA SALADS, S.L. reserves the right to modify these purchase conditions without prior notice, being able to change, delete, or add both the content and products offered through it, as well as how they appear or are located on their servers. The user is responsible for checking these conditions each time they access and/or browse this website since the ones in effect at the time of requesting the acquisition of products will apply. Orders can only be placed to acquire products without the intention of resale. Any resale or distribution of products acquired through the website is strictly prohibited.

We reserve the right to cancel fraudulent, false, or speculative orders, as well as those orders that have been requested by a customer with whom there may be a difference/dispute in previous orders or when there are reasonable doubts that may lead us to believe that the customer is violating any of the specified purchase conditions or engaging in any illegal activity.

2.- COMMON CONDITIONS AND APPLICABLE LEGISLATION

These general terms and conditions (hereinafter “Conditions”) are governed, among other provisions, by the provisions of Book II of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, and specifically by Title III of Book II, “Contracts concluded at a distance and away from business premises,” as well as by other rules applicable to electronic commerce (Law 34/2002 of July 11 on Information Society Services and Electronic Commerce). Before submitting the purchase order, it is recommended to carefully read these Conditions, print or save them for the purpose of archiving them, and expressly accept them by clicking on the corresponding checkbox in the purchase process.

This contract will come into effect and have full legal effect from the moment the customer or user accepts it.

This contract, and, therefore, the general conditions it incorporates, together with any annexes (if applicable), in addition to being read on this website, can be stored, archived, and reproduced by usual electronic or computer means.

3.- USER OBLIGATIONS

Accessing, browsing, and using the website grants the user the status of a user, and as such, all the Conditions established herein are accepted from the moment the browsing commences.

When placing an order, the user guarantees that they are over 18 years of age and have the legal capacity to enter into binding contracts.

As a user, you are obligated to provide ENLAGLORIA SALADS, S.L. with all the necessary data for accessing and using the services of this website. This information must be truthful, legal, and up to date, and you also consent to us using this information to contact you if necessary.

It is essential that you provide all information that we categorize as mandatory, as failing to do so may prevent us from processing your order. We will not be responsible in any case for possible delays or delivery failures resulting from errors or omissions in this data.

The user must make appropriate use of the services included on the website, always in compliance with the legal framework and refrain from engaging in any activities that could hinder or interfere with its operation.

The website is primarily intended for users residing in Spain. ENLAGLORIA SALADS, S.L. does not guarantee that the website complies with the laws of other countries, either in whole or in part. However, you acknowledge that no data transmission over the Internet can be guaranteed as secure against access by unauthorized recipients, and we cannot be held responsible for any security breaches unless they result from our negligence.

Furthermore, you must take the necessary security measures, both personal and material, to maintain the confidentiality of your username and password. You should immediately notify us in case of the loss, misplacement, theft, or unauthorized access to your username and password, as well as their knowledge by third parties.

 

5.- CONDITIONS APPLIED TO ORDERS

All products offered on this website are sold directly by ENLAGLORIA SALADS, S.L. with CIF B67291393 and located at C/ AVENIR, 66, 08021, BARCELONA.

5.1.-Purchase Procedure

You can browse the website until you find the desired item. Once located, by clicking on it, you will access all the information and details about the product. You can add the product to your cart by clicking on the ‘Add to Cart’ button. You can continue browsing, select more products, and add them to the cart, or go to the final checkout by clicking on the cart icon, where the selected products are listed, or by clicking on the ‘View Cart’ button.

Once in the cart, you can view the list of products you have selected, detailing the unit price, quantity, and total price for each item. In this section, discount coupons can be applied if you have them; you should click on ‘Apply Coupon’ and ‘Update Cart’. In the ‘Cart Total’ section, you can view the total price to be paid, including the corresponding taxes and the discount applied through the coupon.

When you have selected and added all the desired products to the cart and want to proceed with the purchase, you should click on ‘Checkout.’ If you are placing an order with us for the first time, you will be asked to enter your details in the ‘Billing Details’ form. You should select the payment method, accept the website’s terms and conditions, and finally, by clicking on ‘Place Order,’ you can make the payment using the chosen method. If the payment method is a credit card, you will use the payment gateway provided by ENLAGLORIA SALADS, S.L. and managed through your bank. You will need to enter the card number, expiration date, and security code, and then click on ‘Pay.’ The User guarantees and is responsible for ensuring that all the card information provided is valid. If the chosen method is PayPal, you will be redirected to the PayPal payment gateway. If the chosen payment method is a bank transfer, you should make the payment directly to the bank account of ENLAGLORIA SALADS, S.L., which will be provided when you click on ‘Place Order.’

If you are a registered user with an active account, you should enter your username or email and password, and the system will recognize your information. Once you are in your account, you can continue your purchase and finally confirm the order.

Subsequently, the user will receive an email confirming that ENLAGLORIA SALADS, S.L. has received their order; this email will serve as the order confirmation. Likewise, you will be informed by email when your purchase is being shipped.

The user acknowledges that, at the time of purchase, they are aware of certain specific purchasing conditions for the products, which are displayed alongside the presentation and image of each product on the website. These conditions include, but are not limited to, information such as the product name, price, components, weight, quantity, color, details, or characteristics. 5.2.- Coverage of the Offer

The physical delivery area for these items is limited to the following territory: Barcelona city. Any other delivery address will result in the automatic cancellation of the order.

5.3.- Availability

All orders are subject to the availability of products and the absence of any circumstances or force majeure that may affect their supply. In case of difficulties in the supply of products or if products are out of stock, ENLAGLORIA SALADS, S.L. commits to contacting the user and refunding any amount that may have been paid for the product.

It is not possible to provide more precise information about the availability of a product beyond what is displayed on the product information page or other sections of the website. When processing the order, you will be informed as soon as possible by email if any of the products in the order is unavailable. In such a case, no amount would be charged for the unavailable product.

5.4.- Prices, Payment Method, and Security

The prices displayed on the items are the final prices in Euros (€) and include taxes (VAT). The applicable tax rate will be the one legally in force at any given time.

Prices may change at any time, but such changes will not affect orders or purchases for which the user has already received an order confirmation.

Shipping costs are not included in the final prices of the products as shown on the website. In no case will ENLAGLORIA SALADS, S.L. add additional costs to a product’s price automatically; only those that the User has voluntarily and freely selected and chosen will be included.

The accepted payment methods are only as follows:

Credit and debit cards: Through the payment gateway provided by ENLAGLORIA SALADS, S.L. and managed through your bank. You will need to enter your card number, expiration date, and security code CW2. The User guarantees and is responsible for ensuring that all the card information provided is valid. These data will not be stored or manipulated by ENLAGLORIA SALADS, S.L., but will be registered directly in the payment gateway of the corresponding financial institution. For added security, we will use a Secure Electronic Commerce Authentication Service, a system established by Visa/Mastercard/Eurocard, through which the customer authenticates with their issuing bank, and the merchant authenticates with their acquiring bank.

ENLAGLORIA SALADS, S.L. uses all means to ensure the confidentiality and security of payment data transmitted by the user during transactions on the website.

5.5.- Contract with ENLAGLORIA SALADS, S.L. and Order Acceptance

The order will not be accepted until the amount has been charged to your account. After confirming the purchase, you will receive an email as a receipt, but this does not imply that the order has been accepted. Orders are subject to our subsequent review and acceptance.

We will confirm the acceptance of the order in an email in which we will inform you that the order is being processed. Only at that moment will the contract between you and us be formalized, and only for the items related in the shipping confirmation.

5.6.- Order Confirmation and Cancellation

Before completing the order on the website, you can review all the associated details (detailed amounts in all necessary sections – taxes, shipping costs, item selection, etc.) and make corrections as needed.

After confirmation, it will not be possible to modify or cancel the order through the website. You should contact ENLAGLORIA SALADS, S.L. using the forms provided on the website or through the contact information indicated in these terms. In such a case, the order can only be modified or canceled if the item has not entered the shipping phase from our warehouses.

5.7.- Currency and Taxes

In accordance with current legislation, all purchases from our website will be subject to VAT (Value Added Tax). The applicable tax rate will be the one legally in force at any given time.

All prices are displayed in euros (€) and should be considered as the final price to be paid by the customer (including or excluding VAT, depending on the delivery territory).

5.8.- Deliveries: Types, Deadlines, and Issues

The physical delivery of purchased goods will be made in the following territory: Barcelona city.

The physical delivery of purchased goods will be made to the shipping address specified in your order. Home delivery of orders will be carried out by a logistics operator within regular business hours.

Unless there are unforeseen or extraordinary circumstances, the purchase order consisting of the products listed in each order confirmation will be delivered within the timeframe indicated on the website, according to the shipping method chosen by the user, and in any case, within a maximum of 1 hour from the time of order confirmation.

If, for any reason attributable to you, ENLAGLORIA SALADS, S.L. cannot meet the delivery date, we will contact you to inform you of this circumstance. In this case, you can choose to proceed with the purchase by setting a new delivery date or cancel the order with a full refund of the amount paid. In any case, home deliveries are made on business days.

If it is impossible to deliver the order due to the user’s absence, the order may be returned to the warehouse. However, the carrier will leave a notice explaining where the order is located and how to arrange for it to be delivered again.

If the user will not be present at the delivery location during the agreed-upon time slot, they should contact ENLAGLORIA SALADS, S.L. to arrange delivery on another day.

If ____ days/hours have passed since your order is available for delivery, and it has not been delivered for reasons not attributable to ENLAGLORIA SALADS, S.L., ENLAGLORIA SALADS, S.L. will consider that the user wishes to cancel the contract, and it will be deemed terminated. As a result of the contract termination, all payments received from the user will be refunded, except for additional costs resulting from the user’s choice of a delivery method different from the least expensive standard delivery offered on the website, without undue delay and, in any case, within a maximum period of 14 natural days from the date on which the contract is considered terminated.

However, the user should be aware that the transportation costs resulting from the termination may incur additional charges.

Delivery is considered to have occurred when the user or a third party indicated by the user takes physical possession of the products. This is verified through the signature on the receipt of the order at the agreed delivery address.

Any risks related to the products will be the responsibility of the user from the moment of delivery. The user acquires ownership of the products when ENLAGLORIA SALADS, S.L. receives full payment for all amounts due in connection with the purchase or acquisition, including shipping costs, or at the time of delivery if it occurs after ENLAGLORIA SALADS, S.L. has received full payment.

In accordance with the provisions of Law 37/1992 of December 28, on Value Added Tax (VAT), purchase orders for delivery will be considered to be located in the territory of Spanish VAT if the delivery address is in Spanish territory, excluding the Canary Islands, Ceuta, and Melilla.

The usual delivery time will be approximately between 48 and 72 hours after order approval. This period may be extended during sale periods, Christmas campaigns, or in the case of customs procedures or other circumstances arising from (for informational purposes only) geographical distance, weather conditions, wars, strikes, any form of government intervention, supplier non-compliance, etc., as well as any other issues attributable to the logistics operator responsible for product delivery. We are not responsible for any possible delays that may occur due to any of the reasons mentioned above.

If the packaging of the order is damaged at the time of delivery, you should open the package in the presence of the logistics operator to check the condition of the items. If any damage is observed, it should be detailed on the delivery note, and you should get in touch.

5.9.- Technical Means to Correct Errors

In the event of errors in entering the data necessary to process a purchase request on the website, the user can modify the information by contacting ENLAGLORIA SALADS, S.L. through the contact spaces provided on the website and, if applicable, through those provided for contacting customer service, or by using the contact details.

In any case, before clicking on ‘Place Order,’ the user has access to the shopping cart where their purchase requests are recorded, and modifications can be made.

Furthermore, the user can consult the Legal Notice and/or the Privacy Policy of this website to obtain more information on how to exercise their right to rectify, in accordance with the provisions of Regulation (EU) 2016/679 on the processing of personal data (GDPR).

5.10.- Return, Exchange, and Refund Policy

Right of Withdrawal:

There is no right of withdrawal, in accordance with the provisions of Article 103, regarding exceptions to the right of withdrawal, of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, all of this without prejudice to the lack of conformity of articles 114 and 116 of the same law.

5.11.- Return of Defective Products or Shipping Errors

These are all cases in which the User believes that, at the time of delivery, the product does not conform to what was stipulated in the contract or purchase order, and, therefore, they must contact ENLAGLORIA SALADS, S.L. immediately and inform them of the existing non-conformity (defect/error) using the same means or the contact information provided in the previous section.

ENLAGLORIA SALADS, S.L. will inform you on how to proceed with the return of the products, and once returned, they will be examined. Within a reasonable period, you will be informed if a refund or replacement is appropriate.

The amount paid for products returned due to a defect, when it actually exists, will be fully refunded, including delivery costs and any expenses incurred by the User to return the product. The refund will be made using the same payment method that the User used to make the purchase.

6.- PARTIAL NULLITY

If any part of these terms of service is contrary to the law and, therefore, invalid, it will not affect the other provisions that are in accordance with the law. The parties agree to renegotiate those points in the terms of service that are found to be null and incorporate them into the rest of the terms of service.

7.- MODIFICATION OF PURCHASE CONDITIONS

8.- APPLICABLE LAW

This site is located and operates from Spain. All matters relating to this site are governed by Spanish law and are subject to the jurisdiction of the competent courts and tribunals in Spain, without the application of conflict of laws principles.

In cases where the customer is not a consumer or user, or has a domicile outside of Spain, they will be subject to the national courts and tribunals, with an express waiver of any other jurisdiction that may correspond to them.

If the user decides to use or consult this site outside of Spain, they must be aware that they do so on their own initiative and are responsible for compliance with the relevant laws.

This contract will enter into force and have full effect from the moment the customer or user accepts it.
